2.2 Calendar Year Validity: In exceptional circumstances, and at the discretion of resort management, a cancellation may result in the issue of a "Floating Deposit".
-
2.3 Expiration Parameters: Any approved Floating Deposit is strictly valid only within the same calendar year (January 1st – December 31st) in which the original booking was made.
3. Insurance and Liability
-
3.1 Travel and Medical Insurance: 3Will Dive Resort does not provide personal travel, medical, or trip-interruption insurance. Guests are required to secure their own travel insurance if they desire.
-
3.2 Scuba Diving Insurance: Students enrolled in diving courses will be covered under 3Will DiveAssure education policy. This is valid for the duration of their course and training dives only – it does not apply to subsequent guided / fun dives. All diving guests not enrolled in a course who desire insurance must secure their own, independently or via 3Will DAN partner insurance.
4. Resort Property, Assets, and Equipment Damage
-
4.1 Guest Responsibility: Guests are liable for the proper care of resort property, including guest rooms, communal areas, and specialized dive equipment.
-
4.2 Property Damage: While standard wear-and-tear in a marine environment is accepted, any serious, negligent, or malicious damage caused to resort infrastructure, furnishings, or rental dive gear will be financially assessed by management. The full cost of repair or equipment replacement must be settled by the responsible guest prior to departure.
5. Dive Operations, Logistics, and Natural Elements
-
5.1 Operational Authority: 3Will Dive Resort operates within a dynamic marine environment subject to changing weather, volcanic activity, currents, and tidal conditions. To ensure passenger safety, our Boat Captains and Dive staff retain absolute, final authority over dive site selection and vessel schedules. Weather disruptions and potential altered dive itineraries are not at the fault of 3Will.
-
5.2 Performance-Based Certification: Enrollment in any SSI training course covers educational materials and professional instructional time. Final certification is strictly performance-based and dependent on the student successfully meeting all safety and skill competencies as outlined by SSI standards. Refunds cannot be granted if a student is unable to achieve certification requirements.
-
5.3 Medical Conditions and Fitness to Dive: All diving guests and students are legally required to complete and sign standard medical questionnaires prior to entering the water. If a guest has a pre-existing medical condition that requires a physician's sign-off, they must secure a valid medical certificate before diving can commence. 3Will Dive Resort accepts no responsibility or financial liability if a guest is deemed medically unfit to dive by an instructor or physician. 3Will is not responsible if a guest fails to disclose a medical condition that results in a diving malady.
-
5.4 Dietary Restrictions and Allergies: While our kitchen team works diligently to accommodate dietary needs (including vegetarian, vegan, and specific food groups), guests must explicitly declare any severe allergies or dietary restrictions at the time of booking or immediately upon check-in. 3Will Dive Resort assumes no liability for adverse reactions resulting from undisclosed allergies or unstated medical dietary requirements.
6. Transport, Logistics, and Flight Disruptions
-
6.1 Flight Delays and Cancellations: 3Will Dive Resort is not financially responsible or liable for any missed transfers, shortened stays, or lost diving days caused by airline delays, flight cancellations, luggage losses, or ferry schedule adjustments.
7. Environment and Property Environment Disclaimer
-
7.1 Island Environment: 3Will Dive Resort is located on an island ecosystem dominated by volcanic and mountainous terrain. Guests acknowledge that tropical island environments present distinct natural elements.
-
7.2 Domestic Animals: The resort property features friendly, resident domestic dogs managed by the resort. By confirming a booking, guests accept that domestic animals are present in the communal and outdoor areas of the resort.
